Acceptable Use Policy (AUP) 

The Acceptable Use Policy or "AUP" is provided to customers, users, and/or visitors to aDigitalHost. All customers, users, and/or visitors must comply to this AUP and the Terms of Service. The use of aDigitalHost's website, programs, and services constitute an acceptance to aDigitalsHost's AUP as well aDigitalHosts Terms of Service Agreement.

aDigitalHost, under any circumstances does not allow Spamming , pornography, warez, sites engaged with illegal activity (either directly, indirectly, and/or promoting illegal activity and/or racial hatred.) 

On a regular basis we check all resources usages of accounts for measurements of the server utilization and server distribution.  No single account may use more than 10% of the total server resources in any 24 hour period.  If there is a violation to this there may be additional costs and fees applied.  We will notify the customer upon our awareness of inappropriate use of our service regarding inappropriate CPU usage and hard drive access.

If an aDigitalHost account is in violation of the AUP and/or our TOS, we reserve the right to terminate service with no prior notice as well as no refund.  Additionally applicable fees may be charge to the customer if a violation is breached.

Direct Violations of aDigitalHost's Acceptable Use Agreemant

The following are constituted as violations of this AUP:

1. Illegal/Unlawful use:   aDigitalHost does not allow it's service to be used for illegal or suspicious activities, such as, but not limited to :terrorism, racial discrimination, drugs, fraudulent activity, forgery/impersonation, and other unlawful acts.  aDigitalHost can and will cooperate with proper legal authorities in the investigation of any suspected criminal or civil violations.
2. Harm to Minors:  The use of aDigitalHost's services to harm or attempt to harm minors in any way will result in termination of service and possibly reports made to authorities.  This includes, but is not limited to child abuse or child pornography.
3. Harassment/Threats:  aDigitalHost does not allow it's service to transmit any material that harasses, threatens, or encourages bodily harm and/or destruction of property.
4. Spamming/Mail Bombing:  aDigitalHost does not allow it's service to be used for mail bombing or DOS attacks, or spamming, or unsolicited commercial email.
5. Copyright or trademark infringement: aDigitalHost does not allow it's service to be used for transmitting any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other intellectual rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
6. Viruses:  aDigitalHost does not allow it's service to be used for the purpose of spreading or distributing viruses.  Any violations either accidental or intentional will result in immediate termination of service and applicable fees may be applied.
7. Pornography:  Pornography is explicitly prohibited.  Sites containing adult material, links to adult material or adult-oriented merchandise are not permitted. The final determination of what constitutes "adult content" is made by aDigitalHost.  Any violation will result immediate termination of service without a refund, and additional fees may apply.
